1. Acceptance of Terms

By accessing or using WishMyList ("Service," "Platform," "we," "us," or "our") at wishmylist.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

WishMyList is a web-based gift registry and wish list platform that allows registered users to:

• Create and manage gift lists for special occasions (weddings, baby showers, birthdays, etc.)
• Share lists with guests via unique links
• Allow guests to reserve or mark items as purchased
• Communicate with guests via a message board
• Access premium features through a paid subscription (Basic and Premium plans)

3. Eligibility

You must be at least 13 years of age to use WishMyList. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share it with others
• Promptly notify us if you suspect unauthorized access to your account
• Take full responsibility for all activities that occur under your account

We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 24 months.

5. Acceptable Use

You agree NOT to use WishMyList to:

• Post unlawful, harmful, threatening, abusive, or defamatory content
• Impersonate another person or entity
• Upload malware, viruses, or other malicious code
• Harvest or collect personal information of other users without consent
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated bots or scrapers to access the Service without authorization
• Violate any applicable local, state, national, or international law

6. Subscriptions and Payments

WishMyList offers optional paid subscription plans ("Basic" and "Premium") processed securely via Stripe. By subscribing:

• You authorize us to charge your payment method for the selected plan period
• Payments are non-refundable except where required by applicable law
• Your subscription will auto-renew unless cancelled before the renewal date
• We reserve the right to modify pricing with at least 30 days' notice

To cancel your subscription, visit My Subscription in your account settings or contact support@wishmylist.com.

7. Amazon Affiliate Disclosure

WishMyList is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program. When you add items from Amazon or click Amazon links, WishMyList may earn a small commission at no additional cost to you. Our affiliate tag is wishmylist-20.

8. User Content

You retain ownership of any content you submit (list names, descriptions, photos). By uploading content, you grant WishMyList a non-exclusive, worldwide, royalty-free license to display and reproduce such content solely for the purpose of operating the Service. We do not sell your content to third parties.

9. Intellectual Property

All trademarks, logos, software, and design elements of WishMyList are owned by us or licensed to us. You may not copy, reproduce, or distribute any part of the Service without our written permission.

10. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISHMYLIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO WISHMYLIST IN THE 12 MONTHS PRIOR TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless WishMyList, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine to be in violation of these Terms or harmful to other users, us, or third parties.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts of Delaware.

16. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
